PMKM&N successfully defended Sandra Jansky, former Chief Credit Officer of Suntrust Banks, Inc., against Suntrust’s counterclaim seeking over $9 million dollars from Ms. Jansky associated with the bank’s restatement of earnings. Following the grant of summary judgment on Suntrust’s claims, PMKM&N sought to have Suntrust indemnify Ms. Jansky for the fees and costs associated with the defense. The United States District Court for the Northern District of Georgia granted plaintiff’s request under a theory of quantum meruit, and directed Suntrust to pay Mrs. Jansky for not only the fees and expenses associated with the defense, but also for the fees and expenses related to the indemnity enforcement action.
