DePuy Hip Recalls
While DePuy, a sub-company of Johnson & Johnson, has grown to be a multinational medical device manufacturer, they have faced numerous recalls. In 2010, DePuy acknowledged the staggering failure rate for it’s ASR Hip Implant Device and issued a voluntary recall August of that year. A similar story, the DePuy Pinnacle Hip System has been known to fail after only 5 years, coming up short to the industry standard hip devices that usually last over 20 years. The Pinnacle hip implant was taken off the market in 2013 when the FDA tightened their regulations.
DePuy Hip Settlement
In December 2016, Johnson & Johnson and it’s DePuy Orthopaedics unit was ordered to pay over $1 billion in a settlement program for the defective Pinnacle hip implants. Likewise, the DePuy ASR settlement program was developed a few years earlier in 2013 for $2.5 billion dollars and may grow to $4 billion after all claimants have been properly compensated. Each settlement program is designed to compensate patients experiencing metal ion toxicity and other ailments who’ve undergone hip revision surgery to replace the device.
How much can qualified claimants receive from the settlement?
Under the settlement programs a qualified participant receives a “base” award. The amount of the base award is determined by factors such as:
- Length of time the device was implanted
- Patient’s age
- Smoking history
- Body mass index (BMI)
How do I know if I qualify for a DePuy settlement?
