Pope, McGlamry, Kilpatrick, Morrison & Norwood, P.C., a prominent Georgia law firm specializing in civil litigation, announced today that it has been appointed to leadership positions for the Plaintiffs in the Wright Conserve Hip Implant Multi-District Litigation (MDL). The firm will serve as Co-Lead Counsel and Co-Liaison Counsel in the MDL proceeding. Michael L. McGlamry and William Usher Norwood, III will being handling the primary duties of Co-Lead Counsel and Co-Liaison Counsel, respectively, for Pope McGlamry. Between them, Mike McGlamry and Bill Norwood have 75 years of experience in handling complex litigation matters. McGlamry and Norwood will work with Raymond P. Boucher, Co-Lead Counsel, and Helen E. Zukin, Co-Liaison Counsel, both of the Los Angeles, California law firm Kiesel Boucher Larson, P.C., to coordinate the Plaintiffs’ litigation in the Wright Conserve Hip Implant MDL.

The Wright Conserve Hip Implant MDL is a consolidation in the Federal District Court for the Northern District of Georgia of products liability cases from around the country against Wright Medical Technology and its parent company, Wright Medical Group, Inc. Cases pending in the MDL seek to recover for individuals who have suffered injuries from Metal-on-Metal hip implants designed and sold by Wright. Attorneys at Pope, McGlamry, Kilpatrick, Morrison & Norwood, P.C., filed some of the very first cases alleging injuries from Wright hip replacement products and have led the charge, calling for the formation of a consolidated MDL proceeding. Mike McGlamry took the lead in arguing for consolidation in Miami before the Judicial Panel on Multi-District Litigation.
Approximately 30 individual cases have now been consolidated in the United States District Court for the Northern District of Georgia, Atlanta Division. The Hon. William S. Duffey, Jr., United States District Judge, is presiding over the consolidated MDL proceedings. Judge Duffey appointed Pope McGlamry to the leadership roles in his Order of May 3, 2012. The Wright Conserve Hip Implant MDL cases stem from problems suffered by individuals who have had a hip replacement with either the Wright CONSERVE® Hip Implant System or the Wright PROFEMUR® Total Hip System. The Wright Hips resemble the recalled DePuy ASR Hip System and have resulted in similar injuries including, failure, acetabular cup loosening, severe pain, swelling, bone and soft tissue damage, metal poisoning, and other complications. Although a recent symposium at the Annual Meeting of the American Academy of Orthopedic Surgeons (AAOS) concluded that there is no indication for the use of Metal-on-Metal total hip implants and preeminent British medical journal The Lancet reported that Metal-on-Metal stemmed total hip implant systems should not be used, the Wright Metal-on-Metal Hips are still on the market. Pope McGlamry’s Lawyers Appointed to Leadership Committees in Multi-District Litigation Against the NFL

Pope McGlamry’s own Michael L. (“Mike”) McGlamry and Wade H. (“Trip”) Tomlinson have been appointed to leadership committees in the multi-district litigation against the NFL for concussion-related injuries. Over 1500 former NFL players have filed individual lawsuits against the NFL alleging that the NFL had for years misled players concerning the risks associated with concussion-related injuries. Similar to the allegations in the tobacco litigation, the former NFL players claim that the NFL’s committee on concussions spent years downplaying independent research showing the casual link between head injuries in football and long term cognitive issues.

With over 1500 individual claims filed and more being filed every day, it is important for the lawyers that represent former NFL players to appoint certain attorneys to leadership roles. Pope McGlamry is honored that its lawyers were chosen to help lead the NFL concussion litigation. Mike McGlamry has been appointed to the Steering Committee that helps govern the course of the litigation for the former NFL players. Products Liability

 

DePuy ASR Hip Implant System

DePuy Orthopaedics, a subsidiary of Johnson & Johnson, recalled its popular metal-on-metal hip replacement implant after studies reported an unusual high failure rate caused by cup loosening, misalignment, dislocation and fractures.

 

Wright Conserve Hip Implant

Strikingly similar to the design of DePuy’s metal-on-metal ASR Hip Replacement System, Wright Medical Technology has come under fire for the manufacturing of its Conserve Cup and Profemur Hip Implant Systems.  High failure rates and high levels of cobalt and chromium ion toxicity are requiring premature revision surgery.

 

Depuy Pinnacle Hip System

The Pinnacle system uses a metal insert, creating a metal-on-metal application for total hip replacements. The FDA has received numerous complaints and adverse incident reports attributed mostly to its propensity to prematurely separate from the bone.

 

Transvaginal Mesh

This type of surgical mesh is implanted in women to improve pelvic organ prolapse – a condition when a women’s uterus, bladder, or rectum slips out of place. Failures of these products can lead to erosion of the mesh into surrounding tissue, mesh contraction leading to vaginal shrinkage, pelvic pain, and complications involving the urinary system, among others.

 

Automotive Defects

Improperly manufactured or designed automobiles can cause serious injury or death.  Auto defects may include unsafe roofs, child safety seat failure, defective air bags, defective seatbelts, tire defects, defective fuel systems, SUV design errors dangerous ATVs, and faulty braking systems.

Rollover Accidents

Rollovers vehicle accidents are often precipitated by defective tires, sudden swerves to avoid an emergency, or defective design of the vehicle as a whole.  Certain vehicles are particularly susceptible to rollover due to their high center of gravity or other design defects.

 

Fuel Gel Firepots

A firepot is a wickless outdoor torch that uses a jelly-like fuel. Reports have recently emerged where these firepots explode, sometimes causing 2nd and 3rd degree burns to individual(s) nearby.

Defective Pharmaceutical Drugs

 

Actos

Actos is a drug commonly prescribed for treatment of Type 2 diabetes which may be associated with an increased risk of bladder cancer, cardiovascular related injuries such as heart attack, congestive heart failure, heart related death, and other serious and severe health risks.

 

Fosamax

Bisphosphonates are a class of drugs taken primarily by post-menopausal women for the treatment of osteoporosis.  The class includes: Fosamax, Actonel, Boniva, Atelvia, Aredia, Didronel, Skelid, Reclast or Zometa.  However, women may suffer unusual fractures of the femur as a result of the use of these drugs.

 

Topamax

Topamax is an anticonvulsant used to treat certain types of seizures in individuals with epilepsy.  Studies have found a significant risk of birth defects with the use of this drug during pregnancy, including craniofacial clefts.

 

Yaz

Yaz is a drug used as contraception to prevent pregnancy. This drug, also sold as Yasmin and Ocella, has been linked to serious and sometimes fatal, circulatory disease.

 

Paxil

Zoloft, Paxil and other SSRI antidepressants used to treat major depression, OCD, panic, social & generalized anxiety disorders in adults may increase the risk for birth defects when taken by mothers during pregnancy.

 

 Zocor

This prescription statin drug is used by people who need to lower their cholesterol.  Patients prescribed the 80 mg pill have an increased risk of developing rhabdomyolysis, a life-threatening form of muscle disease, which can lead to severe kidney damage, kidney failure, and death.

Class Actions

ATLANTA, GEORGIA – February 13, 2012 – Kimberly J. Johnson has joined Pope, McGlamry, Kilpatrick, Morrison & Norwood, PC as an associate in their Atlanta office. Since 2000, Kim’s practice has been devoted to complex litigation, personal injury, products liability, and appellate practice, most recently with Atlanta firm Doffermyre, Shields, Canfield & Knowles, LLC. “We are incredibly fortunate to have someone of Kim’s caliber working with us,” said Neal Pope for the firm. Kim was born in St. Louis, Missouri. She graduated from DePauw University with a B. Mus. in 1991 and taught music in the public schools for four years before attending law school. On Super Bowl Sunday, ESPN’s “Outside the Lines” focused its entire show on the recent lawsuits against the NFL related to the long term effects of concussions troubling former players.  The show went in to some depth in discussing the allegation that the NFL had for years misled players concerning the risks associated with concussions.  Similar to the tobacco litigation, the NFL’s committee on concussions spent years downplaying independent research showing the casual link between head injuries in football and long term cognitive issues.
