Update of Cases Pope McGlamry is Currently Pursuing

For over 28 years, Pope McGlamry has been at the forefront of all types of complex litigation, including products liability claims, claims involving defective pharmaceutical drugs, class actions, and personal injury claims involving catastrophic injury or wrongful death.  Below is a list of some of the specific cases Pope McGlamry is currently pursuing.

Products Liability

DePuy ASR Hip Implant System

DePuy Orthopaedics, a subsidiary of Johnson & Johnson, recalled its popular metal-on-metal hip replacement implant after studies reported an unusual high failure rate caused by cup loosening, misalignment, dislocation and fractures.

Wright Conserve Hip Implant

Strikingly similar to the design of DePuy’s metal-on-metal ASR Hip Replacement System, Wright Medical Technology has come under fire for the manufacturing of its Conserve Cup and Profemur Hip Implant Systems.  High failure rates and high levels of cobalt and chromium ion toxicity are requiring premature revision surgery.

Depuy Pinnacle Hip System

The Pinnacle system uses a metal insert, creating a metal-on-metal application for total hip replacements. The FDA has received numerous complaints and adverse incident reports attributed mostly to its propensity to prematurely separate from the bone.

Transvaginal Mesh

This type of surgical mesh is implanted in women to improve pelvic organ prolapse – a condition when a women’s uterus, bladder, or rectum slips out of place. Failures of these products can lead to erosion of the mesh into surrounding tissue, mesh contraction leading to vaginal shrinkage, pelvic pain, and complications involving the urinary system, among others.

Automotive Defects

Improperly manufactured or designed automobiles can cause serious injury or death.  Auto defects may include unsafe roofs, child safety seat failure, defective air bags, defective seatbelts, tire defects, defective fuel systems, SUV design errors dangerous ATVs, and faulty braking systems.

Rollover Accidents

Rollovers vehicle accidents are often precipitated by defective tires, sudden swerves to avoid an emergency, or defective design of the vehicle as a whole.  Certain vehicles are particularly susceptible to rollover due to their high center of gravity or other design defects.

Fuel Gel Firepots

A firepot is a wickless outdoor torch that uses a jelly-like fuel. Reports have recently emerged where these firepots explode, sometimes causing 2nd and 3rd degree burns to individual(s) nearby.

Defective Pharmaceutical Drugs

Actos

Actos is a drug commonly prescribed for treatment of Type 2 diabetes which may be associated with an increased risk of bladder cancer, cardiovascular related injuries such as heart attack, congestive heart failure, heart related death, and other serious and severe health risks.

Fosamax

Bisphosphonates are a class of drugs taken primarily by post-menopausal women for the treatment of osteoporosis.  The class includes: Fosamax, Actonel, Boniva, Atelvia, Aredia, Didronel, Skelid, Reclast or Zometa.  However, women may suffer unusual fractures of the femur as a result of the use of these drugs.

Topamax

Topamax is an anticonvulsant used to treat certain types of seizures in individuals with epilepsy.  Studies have found a significant risk of birth defects with the use of this drug during pregnancy, including craniofacial clefts.

Yaz

Yaz is a drug used as contraception to prevent pregnancy. This drug, also sold as Yasmin and Ocella, has been linked to serious and sometimes fatal, circulatory disease.

Paxil

Zoloft, Paxil and other SSRI antidepressants used to treat major depression, OCD, panic, social & generalized anxiety disorders in adults may increase the risk for birth defects when taken by mothers during pregnancy.

 Zocor

This prescription statin drug is used by people who need to lower their cholesterol.  Patients prescribed the 80 mg pill have an increased risk of developing rhabdomyolysis, a life-threatening form of muscle disease, which can lead to severe kidney damage, kidney failure, and death.

Class Actions

Insurance Bad Faith and Coverage Disputes

Under many circumstances, insurance companies make institutional decisions not to honor certain claims even though the claims may be covered under state law. Courts have also found insurance companies to be in bad faith when they fail to promptly investigate claims, refuse to pay claims without reasonable investigation, fail to provide a reasonable explanation for denial of a claim and fail to acknowledge notice of a claim.

Mortgage Fraud/Banking Irregularities

Banks and brokers are increasingly subject to scrutiny for their practices in soliciting and securing loans.  In addition, these entities often fail to properly or legally record and maintain these transactions.

Personal Injury/Wrongful Death

Trial Attorneys

Whether caused by car accidents, tractor-trailer collisions, railroad crossings, or boating or ATV mishaps, Pope, McGlamry, Kilpatrick, Morrison & Norwood, P.C. has a long history of the largest verdicts in the history of litigation in the State of Georgia and around the country.  The team of lawyers that Pope, McGlamry, Kilpatrick, Morrison & Norwood, P.C. engages against well-financed insurance companies and corporations gives the advantage to the individual client.

NFL Concussion

Did the National Football League hide from its players the long-term neurological dangers of playing NFL football? Did it train its players to tackle with their heads, knowing that players would then become more susceptible to neurological injury? These and other concerns form the basis of an individual lawsuit to be brought against the NFL for concussions and other head injuries.

Burn Injuries

Burns of any degree can be extremely painful, and in some cases they will require long periods of recovery and rehabilitation.  Victims are saddled with extended hospital stays, costly surgeries, and ongoing medical treatment.  When a burn injury occurs as the result of another person’s negligent or reckless actions, the victim is entitled to compensation.

Traumatic Brain Injuries

Traumatic brain injury victims who have been injured as a result of the reckless or negligent actions of others have the right to file a personal injury claim and recover damages.  Because brain injuries are among the most expensive injuries to treat, settlements and jury verdicts in these cases are often sizable.

Spinal Cord Injuries

The effects of a spinal cord injury can be devastating. Spinal cord injuries commonly affect every aspect of the victim’s daily life. When a spinal cord injury occurs as a result of the reckless or negligent actions of another party, the victim is entitled to compensation.

Building Construction Accidents

Contractors have a duty to provide a suitable workplace where work can be done under safe conditions and where workers are not at great risk for accident and injury.  When a safe workplace is not provided and a worker is injured as a result of a contractor’s intentional, reckless, or negligent actions, complex issues such as applicable building codes, insurance policies, and workers compensation often arise.

Premises Liability

In the state of Georgia, premises liability laws state that when a person is injured because of dangerous property conditions, that property’s owner or the party responsible for maintenance of the property may be held legally responsible for the victim’s injuries and damages.

Pope McGlamry Ranked First – Tier by U.S. News & World Report, Best Lawyers® in Personal Injury Litigation and Commercial Litigation

November 1st, 2011

pope

Pope, McGlamry, Kilpatrick, Morrison & Norwood, P.C., is honored to announce that it has been ranked a “First – Tier” law firm in the “Best Law Firms” initiative by U.S. News & World Report, Best Lawyers® (“U.S. News” and Woodward/White d/b/a as “Best Lawyers”) in both Personal Injury Litigation and Commercial Litigation. A First –Tier ranking in the “Best Law Firms” 2011 – 2012 edition of Best Lawyers® is considered a top honor as Best Lawyers® is the oldest and most respected peer-review publication in the legal profession.

Best Lawyers® compiles lists of outstanding law firms by conducting exhaustive peer-review surveys in which thousands of leading lawyers confidentially evaluate their professional peers. A law firm is not eligible for ranking unless they have at least one attorney that is included in Best Lawyers as part of its annual peer review assessment, “Best Lawyers in America.” Pope McGlamry boasts a total of nine lawyers that were listed in the 2012 edition of “Best Lawyers in America.” Lawyers voted on expertise, responsiveness, integrity, cost-effectiveness, whether they would refer a matter to a firm, and whether they consider a firm a worthy competitor. The rankings incorporate 3.9 million evaluations of 41,284 individual leading lawyers collected by Best Lawyers® in its most recent annual survey.

Because lawyers and law firms are not required or allowed to pay a fee to be included, a listing in Best Lawyers® is widely regarded within the legal profession as a true honor, conferred on a lawyer or law firm by his or her peers. For a quarter century, Best Lawyers® has helped lawyers and clients find legal counsel in unfamiliar jurisdictions or unfamiliar practice areas, and it has earned the respect of the legal profession, the media, and the public, as the most reliable, unbiased source of legal referrals anywhere.

Law firms ranked by Best Lawyers® have no say in deciding which practice areas they are included in. They are voted into practice areas entirely as a result of the votes they receive from their peers. Both the Atlanta office of Pope McGlamry and the Pope McGlamry Columbus office were conferred a First – Tier Ranking. The Atlanta office was ranked as First – Tier in Personal Injury Litigation for Plaintiffs. The Columbus office was also ranked as First – Tier in Personal Injury Litigation for Plaintiffs as well as for Commercial Litigation and Litigation for Eminent Domain and Condemnation.
